Notice of the Ministry ofForeignTrade and Economic Coopperation ofthe People s Republicof Chinaon the Checked and Ratified Import Companies Operating the 5 Commodities (Steal Included) and Relevant Issues
(Waijingmao Guanjinhanzi [1999] No. 176 May 22, 1999)
Commissions (departments, bureaus) of foreign trade and economic cooperation of the various provinces, autonomous regions, municipalities directly under the Central Government and cities under central planning the Special Commissioner s Offices of MOFTEC in the various localities,the Administration of Quota and License Affairs, all relevant general corporations and all chambers of commerce:
In order to ensure the smooth operation of the import of important commodities and to maintain a good import operation order, according to the Provisional Measures on the Administration of Import Commodities issued by the MOFTEC and the requirements of relevant ministries and commissions and the local import work, the MOFTEC has made a comprehensive clearing up and check on the operation situation of the 5 commodities (steel included) whose import is operated by the companies checked and ratified by the State. The name list of the checked and ratified import companies of the 5 commodities (including steel) for general trade and the name list checked and ratified by the Special Economic Zones (see Appendix Iand II) are published here. The relevant issues are hereby notified as follows:
各省、自治区、直辖市及计划单列市外经贸委（厅、局），各特派员办事处，配额许可证局，各有关总公司，各进出口商会：
为保证重要商品进口工作的顺利开展，维护良好的进口经营秩序，根据外经贸部发布的《进口商品经营管理暂行办法》和有关部委、总公司及地方进口工作的要求，我部对钢材等５种实行核定公司经营的进口商品的经营情况进行了全面的清理和核查。现将钢材等５种商品一般贸易进口核定公司名单和经济特区自行核定公司名单（见附件一、附件二）予以公布，并就有关问题通知如下：
I. Sticking to the principles of Selecting the Excellent and Dynamically Regulating and Controlling , MOFTEC makes the current check and ratification with consideration of the operation ability,performance and the quality of service to domestic clients of the applying enterprises as well as the sensitiveness of different commodities. Import operation qualification is granted to enterprises that meet the operation ability and requirements. For those enterprises that fail to meet the operational ability and requirements, the import operation qualification shall be canceled.
一、外经贸部根据申请企业的经营能力、经营业绩及对国内用户的服务质量，结合不同商品的敏感程度，坚持择优竞选、动态调控的原则核定。对已经具备经营能力和条件的企业，本次赋予其进口经营资格；对已不具备经营能力和条件、服务质量低的企业，相应取消其进口经营资格。
II. Canceling the regulations that for those secondary companies of the corporations directly under the ministries and commissions that have been checked and ratified to operate the commodities whose import is operated by the companies checked and ratified by the State, the scope of business of the general corporations will apply to them after the authorization of the corporations. The Custom shall check and give clearance to the secondary companies on the basis of the bills of document issued by them , which is included in the Notice on Clarifying the Relevant Issues of Import Waijing maoguanfa [1996] No. 618 The MOFTEC shall directly grant the import operation right to operating enterprises. From now on, none of the enterprises under central administration and companies under ministries, commissions and offices are allowed to grant operation right to secondary companies. The Customs shall directly check and give clearance to enterprises on the basis of the bills of document issued by the operation enterprises. Banks and the departments of foreign exchange administration shall make payment and cancellation after verification according to these bills of document.
二、取消外经贸部《关于明确进口经营有关问题的通知》（〔１９９６〕外经贸管发第６１８号）有关“各部委直属总公司经核定可经营国家实行核定公司经营商品的，其二级公司经总公司授权，可适用总公司的经营范围，海关凭二级公司出具的有关单证验放”的规定。我部将进口经营权直接赋予经营企业，今后各中央管理企业、各部委办总公司不得再将经营权赋予二级公司，海关直接凭经营企业出具的有关单证验放，银行和外汇管理部门据此进行付汇和核销管理。
III. Canceling the checked and ratified operation administration of the processing with imported steel. Relevant enterprises that want to operate in the business of steel processing shall go through formalities in accordance with relevant regulations on processing trade made by the State.
三、取消钢材进料加工的核定经营管理。有关企业开展钢材加工贸易业务，按照国家关于加工贸易的有关规定办理。
IV. The issuing organizations at all levels shall grant import license and import registration certificates strictly in accordance with the name list of enterprises checked and ratified this time. The foreign trade and economic cooperation departments in various localities shall strengthen the guidance and coordination administration on operational enterprises in accordance with the relevant regulations of MOFTEC.MOFTEC shall cancel the import operation qualification of enterprises that go against national law and relevant regulations.
四、各级发证机关要严格按本次核定的企业名单发放进口许可证和进口登记证；各地外经贸主管部门要按照外经贸部的有关规定加强对经营企业的指导和协调管理。对违反国家法律和有关规定的企业，外经贸部将取消其进口经营资格。
V. The operation scope of companies checked and ratified by the Special Economic Zones and the import companies in Suzhou Industrial Park checked and ratified by MOFTEC is limited in the import of commodities used within the S. E. Zs and the Industrial Park through import agencies.
五、经济特区自行核定的公司和经我部核定的苏州工业园区进口公司限于代理特区和工业园区自用商品的进口。
VI. This notice shall come into force on July 1. For enterprises whose import operation qualification has been cancelled in the current check and ratification, and have applied for import licenses or import registration certificates before July 1, the effectiveness of the notice shall be embodied before August 1.
All relevant regulations and enterprises name lists released in the past which are not in conformity with this notice, shall be subject to this notice.

六、本通知自７月１日起执行，对在本次核定中被取消经营资格的企业且于７月１日前申领进口许可证或登记证明的，须在８月１日前执行完毕。
我部过去发布的有关规定和公布的企业名单，凡与本通知不一致的，一律以本通知为准。
特此通知。

Sticking to the principles of Selecting the Excellent and Dynamically Regulating and Controlling , MOFTEC makes the current check and ratification with consideration of the operation ability,performance and the quality of service to domestic clients of the applying enterprises as well as the sensitiveness of different commodities. Import operation qualification is granted to enterprises that meet the operation ability and requirements. For those enterprises that fail to meet the operational ability and requirements, the import operation qualification shall be canceled.
一、外经贸部根据申请企业的经营能力、经营业绩及对国内用户的服务质量，结合不同商品的敏感程度，坚持择优竞选、动态调控的原则核定。对已经具备经营能力和条件的企业，本次赋予其进口经营资格；对已不具备经营能力和条件、服务质量低的企业，相应取消其进口经营资格。
II. Canceling the regulations that for those secondary companies of the corporations directly under the ministries and commissions that have been checked and ratified to operate the commodities whose import is operated by the companies checked and ratified by the State, the scope of business of the general corporations will apply to them after the authorization of the corporations. The Custom shall check and give clearance to the secondary companies on the basis of the bills of document issued by them , which is included in the Notice on Clarifying the Relevant Issues of Import Waijing maoguanfa [1996] No. 618 The MOFTEC shall directly grant the import operation right to operating enterprises. From now on, none of the enterprises under central administration and companies under ministries, commissions and offices are allowed to grant operation right to secondary companies. The Customs shall directly check and give clearance to enterprises on the basis of the bills of document issued by the operation enterprises. Banks and the departments of foreign exchange administration shall make payment and cancellation after verification according to these bills of document.
二、取消外经贸部《关于明确进口经营有关问题的通知》（〔１９９６〕外经贸管发第６１８号）有关“各部委直属总公司经核定可经营国家实行核定公司经营商品的，其二级公司经总公司授权，可适用总公司的经营范围，海关凭二级公司出具的有关单证验放”的规定。我部将进口经营权直接赋予经营企业，今后各中央管理企业、各部委办总公司不得再将经营权赋予二级公司，海关直接凭经营企业出具的有关单证验放，银行和外汇管理部门据此进行付汇和核销管理。
III. Canceling the checked and ratified operation administration of the processing with imported steel. Relevant enterprises that want to operate in the business of steel processing shall go through formalities in accordance with relevant regulations on processing trade made by the State.
三、取消钢材进料加工的核定经营管理。有关企业开展钢材加工贸易业务，按照国家关于加工贸易的有关规定办理。
IV. The issuing organizations at all levels shall grant import license and import registration certificates strictly in accordance with the name list of enterprises checked and ratified this time. The foreign trade and economic cooperation departments in various localities shall strengthen the guidance and coordination administration on operational enterprises in accordance with the relevant regulations of MOFTEC.MOFTEC shall cancel the import operation qualification of enterprises that go against national law and relevant regulations.
四、各级发证机关要严格按本次核定的企业名单发放进口许可证和进口登记证；各地外经贸主管部门要按照外经贸部的有关规定加强对经营企业的指导和协调管理。对违反国家法律和有关规定的企业，外经贸部将取消其进口经营资格。
V. The operation scope of companies checked and ratified by the Special Economic Zones and the import companies in Suzhou Industrial Park checked and ratified by MOFTEC is limited in the import of commodities used within the S. E. Zs and the Industrial Park through import agencies.
五、经济特区自行核定的公司和经我部核定的苏州工业园区进口公司限于代理特区和工业园区自用商品的进口。
VI. This notice shall come into force on July 1. For enterprises whose import operation qualification has been cancelled in the current check and ratification, and have applied for import licenses or import registration certificates before July 1, the effectiveness of the notice shall be embodied before August 1.
All relevant regulations and enterprises name lists released in the past which are not in conformity with this notice, shall be subject to this notice.

六、本通知自７月１日起执行，对在本次核定中被取消经营资格的企业且于７月１日前申领进口许可证或登记证明的，须在８月１日前执行完毕。
我部过去发布的有关规定和公布的企业名单，凡与本通知不一致的，一律以本通知为准。
